Authorizes a phlebotomist to withdraw blood for a blood alcohol analysis to be used as evidence of driving while under the influence of intoxicants. <b>Removes the time limit by which a prosecuting attorney must elect to treat a misdemeanor as a Class A violation or a specified felony as a Class A misdemeanor.</b> Declares an emergency, effective on passage.
