AN ACT relating to controlled substances; providing for an enhanced penalty for controlled substance offenses related to the distribution or delivery of fentanyl to minors; making conforming amendments; providing definitions; and providing for an effective date. This act provides separate and enhanced penalties for persons who distribute fentanyl to minors. Any person who is at least age eighteen (18) and distributes fentanyl to a person under age eighteen (18) is guilty of a felony punishable by a fine specified in statute for certain controlled-substance offenses and imprisonment for up to twice the term authorized in W.S. 35-7-1031(a)(ii). The fine for this offense may be up to ten thousand dollars ($10,000.00), and the term of imprisonment may be up to twenty (20) years. The act defines "fentanyl" to include any isomer or other substance within the specific chemical designation of fentanyl.
