The Overview

If you run a family daycare home or work at a childcare center in California, California's Assembly Bill 190, titled "Early care and education," became law after Democratic Gov. Gavin Newsom approved it Sept. 18. The bill declares that it takes effect immediately. The law addresses a child care system under strain: the California Budget & Policy Center found that 89 percent of income-eligible children lacked access to subsidized child care as recently as 2022, and the Public Policy Institute of California reported in 2025 that reimbursement rates had not kept pace with rising costs.

What the Law Does

On health and safety training, the law temporarily narrows who must complete the required 15 hours of training, including pediatric first aid and CPR: instead of all staff, just one director or teacher per center must complete it, along with each family daycare home licensee. That relief ends Oct. 1, 2027, when the broader requirement returns.

The law also expands how providers can use up to five paid staff training days per contract period, allowing them to cover professional development and be taken as full or partial days. Family childcare home providers using those days must be paid based on their maximum certified hours of care.

Contractors must pay family childcare providers for state preschool services without deducting family fees, though they must still collect those fees separately, by no later than Jan. 1, 2027. The law also extends quarterly reporting on the subsidized childcare reimbursement rate system through July 1, 2028, and reappropriates $1 million for children's camp safety, with funds available through June 30, 2027.

Legislative Status

The Assembly Committee on Budget sponsored the bill. The Assembly passed it 53 to 17 on March 20, 2025. The Senate passed it 32 to 0 on Aug. 31, and the Assembly concurred in the Senate amendments 62 to 1 the same day.

EveryChild California described the law as providing temporary relief from the expanded health and safety training requirements while setting a broader mandate to begin later.
