The Bill
On July 14, the Senate confirmed Matthew A. Schwartz of New York to be a U.S. Circuit Judge for the Second Circuit, one of the nation's most influential courts. The Senate approved Schwartz's nomination 50 to 45, with all 50 Republicans voting yes and 43 Democrats voting no. The two Independent senators also opposed the nomination. Four senators (two Democrats and two Republicans) did not vote. Darline Graham, who filled her late brother's seat, was sworn in as a Republican senator for South Carolina the same day as the vote.
Sen. James Justice, a Republican from West Virginia, did not buck his party: his non-vote did not contradict the Republican majority position to confirm Schwartz. However, Justice has missed 37 votes during his time in the 119th Congress. Schwartz will assume his seat on the Second Circuit bench now that his confirmation is complete.
