The Good Samaritan Menstrual Products Act protects companies, manufacturers, and nonprofit organizations from lawsuits when they donate menstrual products to nonprofits for distribution to people in need. The law covers donations of sanitary napkins, tampons, menstrual cups, and similar products, as long as the items are in apparently usable condition and meet all quality and labeling standards required by law. Both donors and nonprofits receiving these products are shielded from liability for civil or criminal claims related to the age, packaging, or condition of the donated items, provided they acted in good faith. The only exception is if someone acts with gross negligence or intentional misconduct that causes injury or death to a user. This legislation aims to encourage businesses and manufacturers to donate surplus or older inventory menstrual products to organizations serving low-income individuals who struggle to afford these essential items.
