To amend part E of title IV of the Social Security Act to require States to follow certain procedures in placing a child who has been removed from the custody of his or her parents.
The Samier Amer Foster Care Improvement Act of 2024 requires states to follow new procedures when placing children removed from their parents' custody. Within 90 days of making a placement decision, states must notify all relevant parties including parents, relatives interested in caring for the child, guardians, attorneys, and the child if age-appropriate, along with written reasons for the decision. The bill also establishes a process allowing recipients of this notice to request documentation within five days and permits the child's attorney to petition a court to review the placement decision, with courts required to begin review within seven days. The law takes effect on the first day of the first fiscal year after enactment, though states that need to pass legislation to comply may have additional time until after their next regular legislative session.
