This joint resolution proposes a constitutional amendment that would establish that no person in the U.S. government, including the President and Vice President, is above the law or exempt from criminal prosecution. The amendment would make clear that laws of general applicability apply to the President unless a law specifically states otherwise, and would hold all government officials accountable for both their official and unofficial actions. The resolution would also give Congress the power to toll, or pause, the statute of limitations for crimes committed by a sitting President until after that person leaves office, ensuring they cannot escape prosecution simply by serving out their term. Like all constitutional amendments, this proposal would require approval from two-thirds of both the Senate and House, followed by ratification by three-fourths of state legislatures to become part of the Constitution. The resolution was introduced by Senator Hirono and over 30 other Democratic senators in August 2024.
