The Patient Right to Shop Act prohibits health insurance companies and employer health plans from blocking patients' access to prescription drug pricing information. Specifically, insurers cannot sign contracts with pharmacy benefit managers that restrict third-party consumer decision-support tools from accessing data about medication costs, including copayments, coinsurance, out-of-pocket expenses, and alternative savings options like manufacturer discounts or cash prices. Pharmacy benefit managers must provide this pricing data in machine-readable format at no cost to insurers or the companies offering these comparison tools. The bill applies to both group health plans and individual health insurance coverage and would take effect two years after enactment. Federal agencies from the Departments of Health and Human Services, Labor, and Treasury must issue draft regulations within one year to implement these requirements.
