The Economic Inclusion Civil Rights Act of 2023 strengthens federal civil rights protections by expanding the definition of discrimination in economic activities to include practices that have a disparate impact on non-White persons, even when discrimination is not intentional. The bill addresses what Congress identifies as weakening of civil rights law by two Supreme Court decisions and redefines economic activity broadly to cover contracts, employment, lending, housing, retail, and online transactions. It applies these protections against both private discrimination and government discrimination, shifts the burden to defendants to justify practices that disproportionately harm non-White people, and allows individuals harmed by violations to sue for damages or seek other legal relief. The legislation applies to all pending and future civil rights claims and provides a four-year statute of limitations for bringing cases.
