To exclude certain individuals subject to certain deferred action from eligibility for health plans offered on the Exchanges, advance payments of the premium tax credit, cost-sharing reductions, a Basic Health Program, and for Medicaid and the Children's Health Insurance Programs, and for other purposes.
This bill would exclude individuals who received deferred action under the 2012 Deferred Action for Childhood Arrivals program from accessing health insurance through the Affordable Care Act exchanges, Medicaid, and the Children's Health Insurance Program. Specifically, it would make DACA recipients ineligible for marketplace health plans, premium tax credits, cost-sharing reductions, and Basic Health Programs, even though they are currently considered lawfully present. The bill also extends these restrictions to Medicaid and CHIP coverage, prohibiting states from using federal funds to provide benefits to these individuals. Within 30 days of enactment, the bill requires the Secretary of Health and Human Services to rescind any existing waivers that would conflict with these new restrictions. The legislation contains no new funding provisions, as it focuses on restricting access to existing programs rather than creating new spending.
