The USDA CROP Act of 2023 strengthens coordination between the U.S. Department of Agriculture and the Environmental Protection Agency during the pesticide registration and review process. The bill requires the USDA's Office of Pest Management Policy to provide the EPA with agricultural use data and information about economically viable alternative pesticides before the EPA makes decisions that could restrict or eliminate pesticide uses. When the EPA proposes more restrictive pesticide changes, it must give the USDA ninety days to comment, and the EPA must publicly respond to those comments and explain how it used or rejected the USDA's data. If the USDA indicates there is no economically viable alternative to a pesticide, the EPA must delay the effective date of any restrictions until after the next full growing season and must consider allowing farmers to sell through existing pesticide supplies rather than implementing immediate bans. The bill primarily affects agricultural producers, pesticide manufacturers, and the two federal agencies involved in pesticide oversight.
