The Hotel Fees Transparency Act of 2024 requires hotels, short-term rentals, online travel agencies, and other booking platforms to clearly and prominently display the total price of lodging—including mandatory service fees—whenever they advertise or offer rooms for sale, rather than tacking on hidden fees later in the booking process. Government-imposed taxes and fees can still be listed separately but must be disclosed before a customer completes a purchase, and businesses may still show optional add-on charges separately from the main price. The Federal Trade Commission would enforce the law as an unfair or deceptive practice, and state attorneys general could also sue on behalf of their residents, though they must coordinate with the FTC and cannot act while the FTC is pursuing the same case. The bill includes a legal shield for booking platforms that unknowingly relied on inaccurate pricing information from a hotel and promptly corrected it, and it would override conflicting state or local pricing-display laws while leaving general contract, tort, and fraud laws intact. The new pricing rules would take effect 450 days after the bill becomes law and would apply only to bookings made after that date.
