The Treatment Court, Rehabilitation, and Recovery Act of 2023 creates a new federal grant program to help states and local governments establish or improve treatment courts for people with substance use disorders and co-occurring mental health conditions. The bill covers six types of courts: juvenile drug courts, family treatment courts, tribal healing courts, impaired driving courts, adult drug courts, and other courts meeting national best practice standards. Eligible participants must have a diagnosed substance use disorder or mental illness, pose no risk of violence, and cannot have been charged with sex offenses or murder. The federal government can cover up to 75 percent of program costs, with grants funding treatment services, case management, job training, housing, and other support services, though administrative costs are capped at 10 percent. The bill authorizes $100 million annually from fiscal years 2024 through 2028, and requires a national evaluation of the courts' effectiveness to be submitted to Congress within three years of enactment.
