# AIR FAIR Act Summary The AIR FAIR Act imposes new surcharges on private jet operators and first and business class airline passengers, effective January 1, 2024. Private jet operators pay based on calculated greenhouse gas emissions from their flights, with domestic flights charged at $190 per ton of carbon dioxide equivalent (adjusted annually for inflation plus 10 percentage points), while international flights face flat fees ranging from $1,500 to $10,000 depending on flight duration, with doubled charges for larger aircraft. First and business class ticket purchasers pay surcharges ranging from $75 for flights under 2 hours to $600 for flights over 6 hours, with reductions available for fuel-efficient aircraft, sustainable aviation fuel use, and carbon offset programs. Revenue from these surcharges is allocated starting in fiscal year 2026: 2 percent funds EPA administration, 25 percent supports airport equipment upgrades and emissions reductions, 3 percent funds aviation impact research, 15 percent each go to the Highway Trust Fund and environmental justice grants, 30 percent supports sustainable aviation fuel development, and 5 percent each support FAA airport infrastructure and alternative fuels programs. The bill targets aviation's roughly 3 percent share of U.S. greenhouse gas emissions, which is projected to triple by 2050.
