The AI Labeling Act of 2023 requires developers and users of artificial intelligence systems to clearly label any AI-generated images, videos, audio, text, or other content. Companies must include visible notices identifying content as AI-generated, embed this information in the content's metadata, and make these labels permanent and difficult to remove. The bill applies to any generative AI system used in interstate or foreign commerce and holds both AI developers and third-party companies that license the technology responsible for preventing unauthorized removal of these labels. The Federal Trade Commission will enforce the law and treat violations as unfair or deceptive trade practices. Additionally, the bill requires the National Institute of Standards and Technology to form a working group within 90 days that includes federal agencies, AI developers, social media platforms, and academic institutions. This working group must publish technical standards and best practices for detecting AI-generated content within one year and submit recommendations to Congress on how to implement these standards.
