This bill would prohibit licensed firearms dealers from selling guns or ammunition to anyone convicted of a violent misdemeanor within the previous five years. A violent misdemeanor is defined as a crime involving the use, attempted use, or threatened use of physical force or a deadly weapon, or crimes where someone intentionally or knowingly caused physical injury. The prohibition would apply only to convictions where the defendant had legal representation, either went to trial or knowingly waived the right to a jury trial, and would not apply to convictions that have been expunged, pardoned, or had civil rights restored (unless the pardon explicitly prohibits firearm possession). The bill makes conforming changes to federal firearms laws and the Brady Act to align background check procedures with this new restriction. The law would take effect 180 days after enactment, meaning it would only apply to convictions occurring after that date.
