The Agent Raul Gonzalez Officer Safety Act creates a new federal crime for intentionally fleeing from Border Patrol or assisting law enforcement officers while driving a motor vehicle within 100 miles of the U.S. border. The offense carries penalties of up to 2 years in prison and fines for basic violations, but increases to 5 to 20 years imprisonment if someone is seriously injured and 10 years to life if someone dies as a result. The bill also makes anyone unlawfully present in the United States who commits this offense permanently ineligible to apply for legal status, including asylum. Finally, the legislation requires the Attorney General to submit annual reports to Congress detailing the number of people charged under this new law and what penalties were sought and imposed. The bill was introduced in September 2023 by Senators Ted Cruz and John Cornyn.
