The Fair Day in Court for Kids Act of 2023 would guarantee that unaccompanied children in immigration removal proceedings receive free legal representation provided by the federal government. Currently, children in immigration courts have the right to an attorney but must obtain and pay for one themselves, which many cannot afford. Under this bill, the Secretary of Health and Human Services would appoint counsel for unaccompanied children at no cost, with representation beginning as soon as a child is taken into federal custody and continuing through all stages of their case. The bill also requires that children receive their complete immigration case files at least 10 days before court proceedings and ensures access to attorneys in detention facilities. The legislation authorizes funding for the Office of Refugee Resettlement to carry out these requirements and mandates annual reports to Congress on the progress of providing counsel to affected children.
