The Fortify Israel Act authorizes the U.S. President to confiscate Iranian assets under U.S. jurisdiction and use them to provide military aid and defense equipment to Israel. The bill establishes a fund to hold confiscated Iranian assets, including funds in overseas accounts, and specifies that these resources can be used for procurement of defense articles and services for Israel. Before any previously blocked Iranian assets can be released, the President must certify that hostilities between Hamas and Iran-backed groups have ceased and that either Israel has received full compensation for harms or Iran is participating in an international compensation mechanism. Congress retains oversight authority through a joint resolution process that allows lawmakers to disapprove any asset releases within 30 days of notification. The bill exempts the confiscation authority from judicial review while maintaining protections for private individuals and entities asserting due process claims, and ensures compliance with international agreements including Vienna Convention obligations.
