# Summary of H.R. 3129: Health Care Fairness for All Act
This legislation would fundamentally restructure the American health insurance system by eliminating key provisions of the Affordable Care Act and establishing a new universal tax credit system. The bill repeals the individual and employer health insurance mandates and removes most ACA requirements from health plans, while keeping consumer protections like coverage for pre-existing conditions and dependent coverage through age 26. In their place, it creates a new refundable tax credit of up to $4,000 per individual (doubled for joint returns) to help people purchase health insurance, plus $2,000 per qualifying child, with credits indexed to inflation after 2024.
The bill significantly expands Health Savings Accounts by creating new "Roth HSAs" that don't require tax deductions and allows contributions to be made using the new tax credit. It eliminates deductible traditional HSAs after 2023 and removes the medical expense tax deduction for most purposes. States gain substantial flexibility to regulate health insurance outside federal exchanges, including allowing default enrollment in high-deductible plans with Roth HSAs and permitting higher age-based premium variation.
The legislation also implements major Medicare and Medicaid reforms. For Medicare, it removes restrictions on physician-owned hospitals, promotes site-neutral payments, and allows Medicare Advantage contributions to Roth HSAs. For Medicaid, it establishes a per-beneficiary payment system replacing current funding formulas, creates incentives for chronic care quality improvements, and allows states to shift dual-eligible individuals to managed arrangements. The bill makes telehealth flexibilities permanent and requires hospitals to publicly display their standard charges. The legislation would take effect for tax years beginning after December 31, 2023, with Medicaid reforms beginning July 1, 2022.
