The GOSAFE Act would ban the manufacture, sale, possession, and transfer of gas-operated semi-automatic firearms and large-capacity ammunition magazines holding more than 10 rounds. The bill provides narrow exceptions for firearms designed before enactment and permits transfers between immediate family members through licensed dealers, as well as exemptions for certain low-capacity rifles, shotguns, and handguns. The Attorney General would have 180 days to publish a list of prohibited firearms and would need to approve all new semi-automatic firearm designs before manufacture, with manufacturers able to appeal denials in federal court. The bill authorizes the use of federal crime prevention grants for gun buyback programs and establishes penalties of up to 12 months imprisonment and $5,000 fines for violations, with enhanced penalties of 2 to 10 years imprisonment for those who commit other federal offenses while possessing prohibited firearms. A new Firearm Safety Trust Fund would collect ammunition excise taxes and application fees to support the enforcement activities required under the law.
