The Ban C-FOOD Act would prohibit the importation of seafood and aquaculture products from China beginning one year after the bill is enacted. The ban would remain in place until the Secretary of State certifies that China's fishing fleets and aquaculture industry are not using forced labor, the Secretary of Commerce certifies that China is not providing illegal subsidies to these industries, and the Secretary of Defense certifies that China's fishing fleets will not be used to invade Taiwan. The bill also authorizes the Secretary of the Treasury to impose sanctions on any foreign entities or individuals who attempt to circumvent the ban through transshipment, and requires the U.S. Trade Representative to impose tariffs on seafood from countries that facilitate illegal transshipment of Chinese products. Additionally, the President must submit a report to Congress within 90 days detailing current efforts to combat illegal fishing and forced labor in Chinese fishing and aquaculture industries, along with requests for any additional funding or authorities needed.
