The SAFE Home Act prohibits organizations that receive federal funding for adoption and foster care services from denying or delaying placements based on a prospective parent's decisions regarding gender-related medical treatments or identity document changes for children. Specifically, the bill prevents discrimination against parents who raise children consistent with their biological sex, decline consent for gender-affirming medical or psychological treatments, or refuse to amend identification documents to reflect a different gender identity. The legislation amends the Social Security Act's foster care and adoption assistance program requirements, defining sex as biological sex based on reproductive capacity. The law would take effect in the first fiscal quarter after enactment for federal payments under the relevant Social Security title. States would have until the first calendar quarter after their next regular legislative session to comply if they need to pass new state legislation to meet these requirements.
