The Fans First Act aims to protect consumers from deceptive and unfair practices in the event ticketing market. The legislation prohibits secondary ticket sellers and resale websites from using misleading URLs or artist and venue names without authorization, bans the sale of tickets that sellers do not actually possess, and requires all sellers to clearly display total ticket prices upfront including all fees and taxes. The bill affects ticket sellers, resale platforms, venues, artists, and consumers purchasing tickets to concerts, sports events, theatrical performances, and comedy shows. It strengthens enforcement of the existing BOTS Act (which prohibits ticket-buying bots) by requiring ticket sellers to implement security safeguards, report cyberattacks, and comply with ticket purchase limits, with civil penalties ranging from $10,000 to $15,000 per day for violations. The Federal Trade Commission and state attorneys general are authorized to enforce the law, and the GAO must complete a comprehensive study of the ticketing market within one year of enactment.
