The ADA Improvement Act of 2023 would change how people can sue businesses and public facilities for violating the Americans with Disabilities Act. Currently, people can file lawsuits immediately if they believe a business has violated accessibility rules. This bill would require that before filing a lawsuit, a person must first send written notice by registered mail to the business describing the specific violation, including where and when it occurred. The business would then have 30 days to fix the problem before a lawsuit can be filed. The bill would affect anyone seeking to sue a public accommodation or commercial facility for ADA violations, and it would apply in both federal and state courts. The only exception to this notice-and-wait requirement would be cases where someone is seeking emergency court orders like temporary restraining orders or preliminary injunctions.
