The ATF Accountability Act of 2023 establishes a formal appeals process for licensed firearms manufacturers, importers, and dealers who disagree with rulings or determinations made by the Bureau of Alcohol, Tobacco, Firearms and Explosives regarding product classifications, legal status, or recordkeeping practices. Under the bill, the ATF must issue written rulings on classification requests within 90 days, and licensees can appeal these decisions first to a Director of Industry Operations within 30 days, who must respond within another 30 days. If unsatisfied, licensees can request a formal hearing before an administrative law judge within 14 days, with the judge required to render a decision as quickly as possible based on federal hearing procedures. The bill's appeal process becomes effective immediately for new rulings and also allows licensees one year from the bill's enactment to appeal any previous ATF rulings or determinations. These decisions are designated as final agency action and may be reviewed by federal courts.
