The PROTECT Act of 2024 aims to prevent the nonconsensual distribution of intimate images online and to combat child sexual abuse material on pornography websites. The bill requires adult pornography platforms to verify the age and identity of all users uploading content, obtain explicit written consent from every individual appearing in pornographic images for both the specific sex acts and the distribution of each image, and maintain removal procedures for images shared without consent. Covered platforms must respond to removal requests within 72 hours and block reuploads of removed images. The bill takes effect 90 days after enactment for most provisions and 180 days for reupload blocking. Violations by platforms can result in civil penalties up to $10,000 per day per image, and aggrieved individuals can sue platforms or users directly for actual damages or statutory damages of $10,000 per day. The bill also creates a new federal criminal offense for knowingly publishing intimate visual depictions without consent, punishable by up to five years in prison.
