The Time to Choose Act of 2024 aims to stop consulting firms from simultaneously contracting with the U.S. government and with foreign governments or entities considered national security threats, such as China, Russia, and state sponsors of terrorism. It requires the Federal Acquisition Regulatory Council, within one year of enactment, to update federal contracting rules so consulting firms must certify they don't have contracts with these "covered foreign entities" before winning U.S. government work, and it bars awarding contracts to firms that do have such ties. The bill allows narrow waivers if an agency head determines a waiver serves national security interests and no other qualified firm is available, subject to congressional notification and, in most cases, public disclosure. Firms that submit false certifications face contract termination, possible suspension or debarment, and penalties under the False Claims Act, including triple damages. The bill affects major consulting and professional services firms doing business with the federal government, and it explicitly does not authorize any new funding to implement these changes.
