The FIREARM Act would protect firearm retailers and licensees from license revocation or denial based on violations they report to federal authorities before inspections discover them. Under this bill, the Attorney General must provide licensees with detailed notice of any violation and give them 30 business days to correct it before taking enforcement action, and any violations that are corrected cannot be used as grounds for enforcement. The legislation also allows licensees to request direct judicial review of license revocations in federal district court within 10 business days, during which time the revocation would be stayed pending the court's decision. Additionally, the bill redefines "willfully" to require deliberate planning or specific intent, and specifies that minor or curable violations are presumptively not willful. The bill imposes no specific funding or timeline requirements beyond the 30 business day correction period and the 10 business day window for requesting judicial review.
