The CLEAR Act of 2024 expands the authority of state and local law enforcement to enforce federal immigration laws and requires them to cooperate with immigration enforcement or face penalties. The bill affirms that states have the inherent power to investigate, apprehend, and detain immigrants violating U.S. immigration laws during routine policing activities. States that have policies preventing their officers from assisting federal immigration enforcement will lose federal funding under the State Criminal Alien Assistance Program starting one year after the law takes effect. The legislation requires state and local agencies to submit detailed information about apprehended immigrants to federal authorities, mandates the creation of 20 new federal detention facilities, and provides federal reimbursement to states for costs associated with detaining and transporting immigrants pending federal custody. Additionally, the bill establishes immunity protections for state and local law enforcement officers conducting immigration enforcement, creates training programs and materials for state and local police, and expands the Institutional Removal Program to identify and remove criminal immigrants from all state correctional facilities.
