The Agency Subpoena Compliance Act would establish a process to penalize federal agencies that fail to comply with congressional subpoenas by reducing their funding in the following year's budget. Under the bill, the President must submit a report by October 31 each year listing all subpoenas issued to federal agencies during the previous fiscal year. The House Oversight Committee and Senate Homeland Security Committee would then hold hearings to determine which agencies failed to comply with lawfully issued subpoenas and propose funding cuts of half a percent for each non-compliant subpoena. Agencies that do comply would face no penalty, and if the President submits the report late, the Executive Office of the President would face a two percent funding reduction for each week of delay. The proposed funding reductions would be included as amendments to appropriations bills, allowing Congress to implement the penalties during the budget process.
