The law applies to employers with 25 or more employees and allows workers to use the time to vote on election day, vote early in person, or handle other voting-related activities. Employers can decide when during the day employees take this leave and may require them to vote during early voting periods if allowed under state law. The bill prohibits employers from punishing workers for taking voting leave and establishes civil penalties up to $10,000 per violation, enforced by the Department of Labor. The law would take effect with the first federal election held after it is enacted, and it does not override state or local laws that already provide more generous voting leave.
