This bill would prohibit the Department of Defense from using or contracting with Tutor.com, an online tutoring service currently used by military members and their families. The legislation was introduced in response to Tutor.com's acquisition in January 2022 by Primavera Capital Group, a Chinese company associated with TikTok's parent company ByteDance. Congress is concerned that because Chinese national security laws require companies to share customer data with the Chinese government, military families' personal information—including location data and tutoring session contents—could be exposed to the Chinese Communist Party. The bill requires the Department of Defense to stop offering Tutor.com services within 30 days of the law's enactment and terminate all business relationships as soon as legally possible. The Defense Department would also be prohibited from entering into any future relationships with Tutor.com as long as it remains under Chinese ownership or control.
