The Used Car Safety Recall Repair Act prohibits auto dealers from selling, leasing, or loaning used vehicles that have open safety recalls until the recalls have been repaired. The bill applies to dealers who sell at least five vehicles per year and requires manufacturers to reimburse dealers at a rate of at least one percent of the vehicle's fair market value per month if they fail to make repair remedies available within 60 days of the recall notification. The reimbursement continues until either the repair becomes available or the total payments equal the vehicle's fair market value. The legislation includes some exceptions for recalls that were not publicly available at the time of sale, vehicles sold at wholesale, and junk automobiles that have been properly reported to the National Motor Vehicle Title Information System. The law would take effect one year after it is enacted.
