This bill redefines and improves quality standards for skilled nursing care provided to Medicaid patients. Specifically, it changes the term "private duty nursing services" to "continuous skilled nursing services" and requires that patients needing more than two hours of nursing care daily receive care from licensed nurses. The legislation directs the Department of Health and Human Services to establish national quality standards within one year by convening a working group of nursing providers, patient advocates, state officials, and other stakeholders. The bill also updates federal regulations to include these continuous skilled nursing services in home and community-based waiver programs and requires quality measures to be reviewed and updated every eight years. Most provisions take effect 18 months after the bill is enacted, allowing time for the regulatory changes needed to implement these new standards across state Medicaid programs.
