The Early Participation in Regulations Act of 2024 requires federal agencies to publish an advance notice before proposing major new rules, giving the public an early opportunity to weigh in on potential regulations. A major rule is defined as one that could affect the economy by $100 million or more annually, significantly increase costs, or have major impacts on competition, employment, innovation, or other important areas. Under this bill, agencies must publish the advance notice at least 90 days before formally proposing a rule, solicit public comments for at least 30 days, and describe the problem being addressed, potential regulatory alternatives, and the legal authority for the rule. The legislation includes exceptions when an advance notice would not serve the public interest, would duplicate existing processes, or when statutory or court deadlines make compliance impracticable. The bill contains no new appropriations and places decisions about exceptions with the Office of Information and Regulatory Affairs, whose determinations cannot be challenged in court.
