The Back to Work Act of 2024 limits telework for federal employees to no more than 40 percent of work days in each pay period, unless an agency head approves an exception. The bill affects all executive branch federal employees and allows agencies to further restrict telework based on job duties, employee status, or other circumstances, such as for employees with access to classified information, newly hired workers, or managers. Agencies can waive the 40 percent limit for certain employees, including military spouses, federal law enforcement officer spouses, and those in specialized positions difficult to fill, as well as during emergencies. The legislation requires federal agencies to submit annual reports to Congress detailing how they measure telework productivity, challenges enforcing the limit, and any negative effects on costs or security, with the Government Accountability Office reviewing each report for accuracy. The restrictions take effect 180 days after the bill becomes law.
