The Encampments or Endowments Act would punish colleges and universities that fail to remove student protest encampments from campus by cutting off their eligibility for federal higher education funding, including federal student loans and grants. An institution loses eligibility if a campus encampment lasting seven or more days interferes with core university functions like classes or graduation ceremonies, or blocks students from entering or leaving buildings. Schools declared ineligible could reapply for federal funding after five years. Additionally, the bill imposes a 50 percent annual tax on the endowment assets of colleges that lose federal funding eligibility, unless they provide grants to current students equal to the federal aid those students would have received. The penalties take effect on July 1, 2025, though students already enrolled when a school loses eligibility can continue receiving federal aid through the FAFSA process.
