Read twice and referred to the Committee on Health, Education, Labor, and Pensions.
This bill requires labor unions to disclose detailed financial information about their defined benefit pension plans to employees before union elections. Specifically, unions must provide employees with notices at least three days before an election showing the plan's funding level, how employee contributions would be split between their own benefits and existing retirees' benefits, and estimates of benefit reductions if the plan is underfunded. For underfunded plans, unions must also make an independent financial expert available at no cost to answer employee questions during the three days before the election. The bill establishes significant penalties for violations, including criminal penalties of up to five years in prison for providing misleading information, civil lawsuits by affected employees, and potential invalidation of election results by the National Labor Relations Board. All materials provided must be submitted to the Department of Labor within 30 days after the election and made publicly available online.
