To amend the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code of 1986 to require that group health plans and health insurance issuers offering group or individual health insurance that provide coverage for mental health services and substance use disorder services provide such services without the imposition of cost-sharing from the diagnosis of pregnancy through the 1-year period following such pregnancy, and for other purposes.

The Mental Health and MAMA Act of 2024 requires health insurance plans to cover mental health services and substance use disorder treatment at no cost to pregnant people and new mothers. The coverage would apply from the moment of pregnancy diagnosis through one year after pregnancy ends, and would include telehealth services provided by in-network providers. The requirement applies to group health plans and both group and individual health insurance policies offered by insurers. The law also allows pregnant individuals and those receiving postpartum mental health care to continue seeing the same provider even if that provider leaves their insurance network. The new requirements take effect two years after the legislation is enacted, applying to health plans starting in that second year and onward.
