The Reshape Alternatives to Detention Act of 2024 would significantly restrict and restructure how the Department of Homeland Security handles immigration cases outside of detention facilities. The bill terminates two case management programs designed to monitor immigrants released into the United States and redirects their funding toward creating more immigration detention beds. It requires all available detention beds to be filled before any individuals can be released into alternatives to detention programs, and mandates GPS monitoring for anyone not detained during their immigration proceedings. The legislation also makes it harder for people to participate in alternatives to detention by barring those in sanctuary jurisdictions and requiring mandatory participation in an intensive supervision program with strict check-in requirements within 14 days, with failure to comply resulting in immediate re-detention and expedited removal proceedings. Additionally, the bill requires biometric information collection from all arriving immigrants as a condition for participating in alternatives to detention and restricts the civil rights oversight authority of the Department of Homeland Security.
