The IVF Protection Act would require states to allow in vitro fertilization services as a condition of receiving federal Medicaid funding. Currently, some states have passed restrictions or bans on IVF, and this bill would prohibit such state-level restrictions while also requiring states to ensure their local governments do not ban IVF services. The legislation does not compel any individual doctor, hospital, or organization to provide IVF services, nor does it prevent states from enforcing health and safety standards for the procedure. The bill defines IVF as the collection of eggs from ovaries, manual fertilization by sperm, and placement inside a uterus. By conditioning Medicaid payments on IVF access, the bill uses federal funding as leverage to protect the availability of fertility services nationwide.
