To amend title 18, United States Code, to prohibit foreign nationals from making contributions in connection with a State or local ballot initiative or referendum.
This bill makes it illegal for foreign nationals to contribute money or anything of value to state and local ballot initiatives or referenda. The law applies to both direct contributions and indirect support, as well as any promises to make such contributions. The penalty for violation includes fines of up to the greater of $10,000 or three hundred percent of the contribution amount, and imprisonment for up to one year, or both. The legislation uses the existing definition of "foreign national" from federal election law, which includes foreign governments, political parties, and individuals who are not U.S. citizens or permanent residents. The law takes effect immediately upon enactment and applies to all contributions made after the bill becomes law.
