The Responsibility in Drug Advertising Act of 2024 would restrict pharmaceutical companies from advertising new prescription drugs directly to consumers for at least three years after FDA approval. During the first three years, the FDA could grant a waiver allowing earlier advertising only if the agency determines the drug provides clear public health benefits. After the initial three-year period, the FDA could continue to prohibit or restrict advertising for any drug found to have significant adverse health effects based on post-approval studies and safety data. The bill requires the FDA to update its regulations within one year of the law's enactment to implement these restrictions. The legislation would apply to drugs approved by the FDA starting one year before the law takes effect.
