The SAFE U.S. Facilities Act prohibits the use of federal funds to host officials from China, Russia, state-sponsored terrorism supporters, or their state-owned enterprises at U.S. critical transportation infrastructure, airports, railroads, and certain Department of Defense and Department of Homeland Security facilities. The bill also withholds federal grants from state and local governments and nongovernmental organizations that facilitate or fund visits by representatives of these adversary entities to participate in joint exercises, tours, or meetings involving such facilities. The President can grant limited waivers on a case-by-case basis if determined to be in the national security interest, but each waiver lasts no more than five days, only one waiver can be active at a time, and applies to single non-recurring events. Any waiver requires consultation with defense, homeland security, and intelligence officials and notification to Congress at least five days before implementation, including detailed information about the event, its costs, security risks, and oversight plans.
