This joint resolution seeks to overturn a Department of Justice rule issued in April 2023 that governs home confinement for federal prisoners under provisions of the CARES Act. The rule gave the Attorney General authority to designate eligible prisoners to serve portions of their sentences at home rather than in federal facilities, particularly during emergencies. Congress is attempting to use the Congressional Review Act, a procedural tool that allows lawmakers to disapprove and nullify regulations issued by executive agencies, to eliminate this rule entirely. If passed, the rule would be invalidated and the DOJ would lose the ability to implement these home confinement designations under the CARES Act framework. The resolution was introduced by Senator Marsha Blackburn and supported by 23 Republican senators and referred to the Senate Judiciary Committee.
