The Protecting Patients from Deceptive Drug Ads Online Act would establish new rules to crack down on misleading prescription drug advertising on social media platforms. The bill would hold social media influencers and health care providers liable for false or misleading drug promotions from which they receive financial benefit, requiring them to include the same safety and effectiveness information that traditional drug advertisements must include. The legislation also requires reporting of payments made to influencers and health care providers for drug promotions, and directs the Food and Drug Administration to monitor social media for illegal drug advertising through market surveillance activities. The bill authorizes $15 million annually through 2029 for the FDA to hire additional staff and establish a task force with the Federal Trade Commission to coordinate enforcement efforts, with new rules taking effect 180 days after the FDA issues guidance on how it will implement the law.
