The USDA CROP Act of 2023 requires the Department of Agriculture's Office of Pest Management Policy to work more closely with the Environmental Protection Agency during the pesticide registration and reevaluation process. Under this bill, the USDA office must provide the EPA with agricultural use data and information about the economic viability of pesticide alternatives to help inform EPA decisions that could restrict or eliminate pesticide use. The legislation also gives the USDA office a 90-day period to comment on proposed EPA decisions that would make pesticide labels more restrictive, and requires the EPA to respond to those comments in writing and publish them alongside any proposed changes. If the USDA indicates there is no economically viable alternative pesticide available, the EPA must delay the effective date of restrictions until the end of the following growing season and consider phasing out restrictions rather than implementing them immediately. The bill aims to give agricultural producers more time to adjust when pesticides are restricted or removed from the market.
