The SAFE Contracting Act requires all federal contractors and their subcontractors to enroll in and comply with the E-Verify Program, which verifies employment eligibility. Any company bidding for a federal contract must certify that it is enrolled in E-Verify and fully complying with all related regulations; federal agencies cannot award contracts to companies that fail to make this certification. Agencies must evaluate contractor compliance before awarding contracts, monitor ongoing compliance annually, and post their findings publicly. Companies that fail to comply have 30 days after receiving notice to return to full compliance, or they face suspension and debarment proceedings that could prevent them from winning future federal contracts. Federal procurement agencies have 180 days from the bill's enactment to update their acquisition regulations and implement policies to enforce these requirements, and U.S. Citizenship and Immigration Services must develop data collection measures within one year to track contractor enrollment.
