# Summary of S. 5366, the Ending Racism in Government Contracting Act
This bill would eliminate federal preferences for disadvantaged businesses and individuals in government contracting. Specifically, it removes programs that give special consideration to small businesses owned and controlled by socially and economically disadvantaged individuals, repeals the Minority Business Development Act of 2021, and eliminates racial and ethnic participation goals in Department of Transportation grant programs. The legislation also prohibits federal agencies from considering race or ethnicity when awarding contracts and prevents agencies from requiring contractors to consider race or ethnicity in their own contracting decisions. Within 60 days of enactment, federal agencies would be required to begin removing racial and ethnic preferences from their rules, guidance, and directives, with all changes to be completed within 180 days. The bill maintains preferences for businesses owned by women and veterans, as well as qualified HUBZone small businesses.
